Terms and Conditions of Use – Ibiza Vibes (ibizavibes.travel)

1. Acceptance of Terms

Accessing and using the website www.ibizavibes.travel operated under the trade name “Ibiza Island”, constitutes full and unconditional acceptance of these Terms and Conditions of Use. If you do not agree with any part of these terms, you must refrain from using the site.

2. Purpose of the Website
   Ibiza Vibes acts as a tourism intermediary, facilitating the search, booking, and payment of travel services offered by third-party providers (hereinafter, “Providers”). Our mission is to provide a smooth and professional booking experience for a more comfortable and welcoming stay in Ibiza.
3. Nature of Intermediation

• Ibiza Vibes is not the direct provider of yacht charters, villas, transfers, or activities.
• We operate as a booking platform and agent, receiving user payments and forwarding them to the relevant Providers.
• The final service contract is established directly between the user and the Provider.

4. Our Commitment
   We commit to:

• Managing your booking efficiently and professionally.
• Keeping you informed throughout the reservation process (confirmation, payment, contact).
• Offering friendly customer service and follow-up to ensure satisfaction with the services provided.

5. Limitation of Liability
   Except as specifically required by applicable law, Ibiza Vibes shall not be liable for:

• The quality, safety, or fulfillment of services delivered by Providers.
• Any damages, injuries, losses, or delays resulting from use of those services.
• Operational issues, cancellations, or defaults by Providers.

All claims or complaints must be addressed directly to the respective Provider.

6. Applicable Legal Framework

• Ibiza Vibes operates under Law 8/2012 of July 19th, on Tourism in the Balearic Islands, which regulates tourism intermediation as a distinct business activity.
• We are recognized as a tourism intermediary company in accordance with Article 26 of this Law.
• As intermediaries, we comply with all consumer protection and e-commerce transparency obligations.
• In the case of linked travel services or package travel, the corresponding consumer protection regulations and guarantees shall apply.

7. Payment Terms
   By making a payment through our platform:

• You agree to transfer the total amount for the selected service.
• You acknowledge that service fees and cancellation conditions may apply, always communicated beforehand.

8. Customer Service and Complaints
   We provide:

• A customer support channel for queries or issues.
• Official complaint forms in accordance with local consumer laws in the Balearic Islands.

9. Changes to the Terms
   Ibiza Vibes reserves the right to modify these Terms at any time. Changes will be posted on www.ibizavibes.travel and will take effect from the date of publication.
10. Governing Law and Jurisdiction
    These Terms are governed by Spanish law, especially the Balearic Islands Tourism Law (Law 8/2012 of July 19th) and general consumer and e-commerce legislation. Any disputes will be submitted to the competent courts of Ibiza (Balearic Islands).
